FDA REGULATORY AND COMPLIANCE NEWS
  • Today, FDA issued a final rule entitled, “Further Amendments to General Regulations of the Food and Drug Administration to Incorporate Tobacco Products,” which amends certain general regulations to include tobacco products, ensuring that tobacco manufacturers adhere to regulations that apply to other FDA-regulated products.  The Rule also clarifies FDA’s policies for voluntary recalls of tobacco products and guarantees tobacco manufacturers the same rights as other FDA-regulated entities.  [FR Notice]
  • Pfizer has recalled nearly one million packs of its Lo/Ovral-28 birth control pills and generic Norgestrel versions due to packaging problems which resulted in blister packs containing an incorrect number of active or inert pills, or pills out of order.  Pfizer stated its belief that only 30 packages were affected, but provided public notice of a full recall late Tuesday after a request from FDA.   • Yesterday, FDA Commissioner Dr. Margaret Hamburg supported providing FDA with the authority to set civil penalties when drug sponsors fail to complete pediatric studies within the timeframe promised to the agency.  Dr. Hamburg’s remarks came during the House Energy and Commerce Committee’s Health Subcommittee hearings on the reauthorization of the Prescription Drug User Fee Act (PDUFA), which is also discussing reauthorization of the Pediatric Research equity Act (PREA) and the Best Pharmaceuticals for Children Act (BPCA).  (The Pink Sheet Daily)

 

POLICY AND LEGISLATION NEWS
  • Representative Edward Markey (Democrat – Massachusetts) has introduced a bill, entitled “Safety of Untested and New Devices Act of 2012,” primarily intended to limit the body of medical devices available for use as predicates during the 510(k) process.  The bill also includes provisions to grant FDA new authority to reject claims of substantial equivalence and increase the amount of data required as part of the 510(k) submission process.  [HR 3847] (FDA Law Blog)
