FDA REGULATORY NEWS
  • FDA yesterday released minutes from multiple negotiation sessions over the 2012 user fee pact between FDA and medical device industry representatives, which indicate that the two sides have reached agreement on key points, but are still debating the amount of fees that industry would contribute.  The agreed upon draft commitment letter will form the basis for performance metrics to be included in the final user fee agreement for the fiscal years 2013 through 2017, but FDA cautioned that some of the objectives may not be possible if industry does not agree to increase the amount of fees it is willing to pay.  (Health News Daily)  
  • FDA published today its quarterly update on premarket approval (PMA) applications, entitled “Medical Devices; Availability of Safety and Effectiveness Summaries for Premarket Approval Applications.”  The document lists summaries of safety and effectiveness of approved or denied PMAs that were posted on the Internet from July 1, 2011 through September 30, 2011.  [FR Notice]   
  • Yesterday, FDA published a new page on its website detailing the Center for Devices and Radiological Health’s (CDRH) Innovation Pathway program, and called for voluntary submission of innovative device applications for End-Stage Renal Disease (ESRD) as part of its Innovation Challenge to pilot this new program.  The Innovation Pathway is part of CDRH’s larger Innovation Initiative launched February 8, 2011.  [Innovation Pathway] [Innovation Challenge] (FDA.gov)

 

POLICY AND LEGISLATION NEWS
  • FDA Commissioner Dr. Margaret Hamburg is expected to appear before the House Energy and Commerce Committee on February 1, 2012 as Congress begins discussion of the fifth iteration of the Prescription Drug User Fee Act (PDUFA V), which FDA has stated it will send to Congress on or about January 15.  A major discussion during PDUFA V hearings will be to determine the new authorities that FDA may receive as part of the Act, which will likely include new means for the agency to address drug shortages.  US Representative Joe Pitts (Republican – Pennsylvania), chairman of the Health Subcommittee, has set a goal of sending PDUFA V legislation to President Obama for signature in June, 2012.  (The Pink Sheet Daily)
